By booking a bike fit with Paihikara AB trading as Studio l’Echelon (‘Echelon’) you agree to these terms and conditions in addition to the relevant terms and conditions of service of Studio l’Echelon.
1. No Medical Purpose or Use.
I acknowledge and agree that (i) the Bikefitting.com system (‘System’) is not designed to identify a riding position or pedalling performance that is suitable for an existing medical or health condition or any other physical condition that is individual to me, (ii) the System cannot take into account any medical, health, or physiological conditions or injuries in identifying a proper riding position or more efficient pedalling performance, (iii) the System should not be used as a medical instrument and is not intended for medical treatment, diagnosis, or prevention, (iv) the System is not a substitute for consultation with a physician or similar health care professional, and (v) I am responsible for the decision on whether to accept a riding position.
2. Proper Handling of Bicycle.
If I choose to adjust or modify my bicycle based on the results of my use of the bike fit, I agree that I will have a person trained and experienced in the assembly and maintenance of bicycles (which may include the authorised staff from Echelon) to make any such adjustments or modifications. I will verify the correctness of any advice from Echelon regarding recommended size of frame for purchase from the vendor.
3. Warranties and Liability
Echelon does not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. Echelon does not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Echelon, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. In any case damages shall be limited to the cost of the bike fit paid by you.

Genom att boka en bikefit med Studio l'Echelon ('Echelon') godkänner du dessa villkor

eller fysiologiska tillstånd eller skador vid identifiering av en korrekt position på cykeln eller effektivare pedalprestanda, (iii) Systemet ska inte användas som ett medicinskt instrument och är inte avsett för medicinsk behandling, diagnos eller förebyggande, (iv) Systemet är inte en ersättning för konsultation med en läkare eller liknande sjukvårdspersonal, och (v) jag är ansvarig för beslutet om huruvida jag ska acceptera förslaget på position på cykeln.
2. Korrekt hantering av cykeln.
Om jag väljer att justera eller modifiera min cykel baserat på resultaten av min bikefit, samtycker jag till att det ska göras av en person som är utbildad och har erfarenhet av montering och underhåll av cyklar (vilket kan innefatta Echelons auktoriserade personal) för att göra sådana justeringar eller modifieringar. Jag kommer att kontrollera med cykelförsäljaren att Echelons råd om rekommenderad storlek på ramen vid köp är korrekta.
3. Garantier och ansvar
Echelon garanterar inte att din användning av vår tjänst kommer att ske utan avbrott, i rätt tid, säkert eller felfritt. Echelon garanterar inte att de resultat som kan erhållas genom användning av tjänsten kommer att vara korrekta eller tillförlitliga. Du samtycker till att vi från tid till annan kan ta bort tjänsten på obestämd tid eller avbryta tjänsten när som helst, utan att meddela er.

Echelon, våra styrelseledamöter, tjänstemän, anställda, dotterbolag, ombud, leverantörer, praktikanter, tjänsteleverantörer eller licensgivare skall under inga omständigheter vara ansvariga för någon skada, förlust, anspråk eller direkt, indirekt, tillfälliga, straffrättsliga, särskilda eller följdskador av något slag, inklusive, men inte begränsat till förlorad vinst, förlorade intäkter, förlorade besparingar, förlust av data, ersättningskostnader eller liknande skador, oavsett om baserat på kontrakt, skadestånd (inklusive försumlighet), strikt ansvar eller annat, som härrör från din användning av tjänsten eller några produkter som anskaffats med hjälp av tjänsten, eller för något annat krav som på något sätt är relaterat till din användning av tjänsten eller någon produkt, inklusive, men inte begränsat till, eventuella fel eller utelämnanden i något innehåll, eller förlust eller skada av något slag som uppkommit till följd av användningen av tjänsten eller något innehåll (eller produkt) som publiceras, överförs eller på annat sätt görs tillgängligt via tjänsten, även om du informeras om deras möjlighet.
